Personal data protection

  1. Identification of the controller, purposes of processing and legal basis for processing

SIMPLY HOLEŠOVICE, a.s. with registered office at Pobřežní 667/78, Karlín, 186 00 Praha 8, ID no: 059 00 115 (hereinafter referred to as the "Administrator"), hereby informs all natural persons who have directly or indirectly contacted the Administrator or entered into negotiations with the Administrator in any way for the purpose of expressing interest in the purchase or lease of the real estate forming the ZigZag Haus development project presented on this website (hereinafter referred to as "Persons") that the Administrator processes personal data provided by Persons, in particular, name, surname, title, date of birth, birth number, nationality, permanent residence address and correspondence address, contact details (telephone number, e-mail, data box identifier), bank account number, marital status, if applicable, and data relating to the ownership of the property ("Personal Data") for the following purposes:

  1. presentation of the said development project on this website (legal basis: the legitimate interest of the Controller in the presentation of the project in question (Article 6(1)(f) GDPR)),
  2. negotiation, conclusion and performance of the necessary legal actions aimed at the transfer of the immovable property in question - e.g. conclusion of the purchase contract, completion of the application for the entry of the ownership right in the Land Register, confirmation of receipt of the purchase price or rent payment, etc. (legal basis: necessity for the conclusion and performance of the contract (Article 6(1)(b) GDPR) - in the absence of data, the contract cannot be concluded),
  3. the fulfilment of the Controller's obligations set out in legal regulations related, among other things, to the transfer of ownership rights to the immovable property in question - e.g. tax or accounting obligations or obligations against the legalisation of criminal activities, etc. (legal basis: necessity for the fulfilment of the Controller's legal obligation (Article 6(1)(c) GDPR)),
  4. asserting and defending against legal claims (legal basis: the legitimate interest of the Controller in protecting its own interests (Article 6(1)(f) GDPR)),
  5. sending commercial communications about a given development project, including offers to buy or rent properties within the project (legal basis: consent to sending commercial communications (Article 6(1)(a) GDPR)).

  1. Recipients of Personal Data

For the above purposes, the Controller may also transfer Personal Data of Persons to third parties cooperating with the Controller in connection with the sale or lease of the real estate in question, i.e. with real estate agencies (intermediaries), legal, accounting or tax advisors, the operator of this website and the entity that handles the implementation of client changes to the real estate offered, as well as to advertising agencies, companies providing the distribution of commercial communications and the relevant public authorities in connection with the performance of the legal obligations of the Controller. The Administrator is also entitled to pass on the identification and contact details of the owners or tenants of the transferred immovable property to a future unit owners' association.

  1. Period of processing of Personal Data

Personal Data will be stored and processed by the Controller for the duration of the contractual relationship and for a reasonable period of time after the termination of the contractual relationship in order to protect the rights and legitimate interests of the Controller, or for the period of time specified by law for the retention of Personal Data (if any). Once the purpose of the processing ceases or the Controller no longer has any legal basis for processing the Personal Data, the Controller will delete the Personal Data.

  1. Transfer of Personal Data to third countries

The Controller does not intend to transfer Personal Data to a third country or an international organisation.

  1. Rights of Individuals in relation to the processing of Personal Data

Persons whose Personal Data is processed are entitled (if the legal prerequisites are met) to the relevant rights set out for the purpose of personal data protection under the applicable and effective legislation:

  1. The right of access, i.e. to obtain confirmation from the Controller as to whether or not Personal Data is being processed and, if it is, to obtain access to it (to receive a copy of the Personal Data being processed), or to receive further information about the processing of Personal Data.
  2. The right to data portability, i.e. to receive Personal Data from the Controller in a structured, commonly used and machine-readable format, and the right to transfer this data to another controller.
  3. The right to rectification, i.e. for the Controller to correct inaccurate Personal Data or to complete incomplete Personal Data.
  4. The right to erasure, i.e. for the Controller to erase Personal Data if:
  1. the Personal Data is no longer necessary for the purposes of the processing mentioned above,
  2. Personal data cannot be further processed on the basis of the legal grounds mentioned above,
  3. The individual has objected to the processing of Personal Data and there are no overriding legitimate grounds for processing,
  4. Personal data have been processed unlawfully, or
  5. The personal data must be deleted to comply with the legal obligation of the Controller.
  1. The right to restriction of processing, i.e. for the Controller to restrict the processing of Personal Data if:
  1. The person denies the accuracy of the Personal Data for the time necessary to verify the accuracy of the Personal Data,
  2. the processing is unlawful and the Person requests the restriction of the use of the Personal Data instead of its deletion,
  3. The Controller no longer needs the Personal Data for the purpose of processing, but the Person requires it for the establishment, exercise or defence of legal claims or
  4. The Person has objected to the processing of Personal Data, pending verification that the legitimate grounds of the Controller outweigh the legitimate grounds of the Person.
  1. The right to withdraw consent at any time if the processing of Personal Data is based on it (e.g. in the case of processing of Personal Data for marketing purposes). However, withdrawal of consent does not affect the lawfulness of the processing of Personal Data prior to its withdrawal.

Furthermore, the Person has the right to object if the processing is based on the legitimate interests of the Controller (Article 6(1)(f) GDPR) or the processing is carried out for direct marketing purposes (including profiling).

A person also has the right to lodge a complaint with the relevant supervisory authority if he or she believes that the processing of Personal Data is in breach of the law. The competent supervisory authority in the Czech Republic is the Office for Personal Data Protection (https://uoou.gov.cz), email: posta@uoou.gov.cz.

  1. Final provisions

The Controller shall ensure, by means of appropriate technical and organisational measures, that Personal Data is processed in a manner that ensures its protection and confidentiality against unauthorised or unlawful processing and against accidental loss, destruction and damage.
